Islamabad – The Federal Constitutional Court has ruled that delaying the delivery of court judgments beyond the stipulated period constitutes a breach of law. Justice Aamir Farooq authored a seven‑page decision ordering all high courts to send copies of preserved judgments for implementation. Under the court’s ruling, high courts must announce preserved judgments within 90 days, and any judgment delivered after that deadline can be declared null and void. The court affirmed that the Supreme Court and high courts’ rules hold the force of law, and anyone violating them must face consequences. Leaking a judgment before a bench’s official announcement breaches these rules, and all judges and court staff are required to fully comply. The bench head may order a fresh hearing if a decision is released early or its points are leaked, and any bench, including the one that preserved the judgment, can rehear the case. If a similar issue arises in a high court, it will be referred to the Chief Justice and the Supreme Court’s judges’ committee. Timely justice is essential, especially when pending cases create a backlog, and there has been a recent rise in the practice of preserving judgments. The court noted that parties endure long waits for their rights until a judgment is finally issued. Judgments are preserved when judges cannot agree on a result or when complex legal issues arise; in the present case, the Sindh High Court announced a preserved judgment after ten months. The Federal Constitutional Court also dismissed the observations made by the Sindh High Court in the Pakistan Shipping Corporation appeal, noting that the corporation had previously challenged the high court’s decision on a pension payment case.
