Islamabad High Court Issues Written Verdict in One Constitution Avenue Case, Rejects Lease Cancellation Petition

Islamabad High Court issued a written decision in the One Constitution Avenue case, rejecting the company’s petition against lease cancellation. Chief Justice Muhammad Sarfraz Dogar delivered the written judgment. The court upheld the CDA’s lease cancellation order dated March 8 2023 as legal. The decision states that the petitioner failed to comply with the financial conditions set by the Supreme Court; CDA’s cancellation aligns precisely with the rights granted by the Supreme Court, and the petitioner did not take advantage of the lifeline opportunity provided by the Supreme Court. Investors may approach the relevant forum for their rights, and the court deemed the petitioner’s Rs 50 crore check insufficient. The judgment notes that the petitioner did not meet the Supreme Court’s financial conditions, and the company failed to deposit the 2022 installment of Rs 2.916 billion. The court also dismissed the petitioner’s objection to a technical error in a 30‑day notice. The Supreme Court, on January 9 2019, restored the lease ordering a payment of Rs 17.5 billion over eight years; the company paid the 2021 installment but defaulted on the 2022 payment. After reminders, CDA issued a notice on February 7 2023 and the lease cancellation order on March 8. Federal Interior Minister Mohsin Naqvi said there has been no change in the stance on One Constitution Avenue in Islamabad, noting that CDA considers the avenue illegal and will maintain that position before the committee. In informal remarks to journalists, the minister said he does not believe this is the biggest fraud in Pakistan’s history, involving judges, bureaucrats, politicians, and bankers who have been profiting from the money for 21 years.
